Edwardsville, IL – A woman from Idaho is suing 65 companies over claims that the mesothelioma she was diagnosed with recently was wrongfully caused.
Evaline Semtner states that she was diagnosed with mesothelioma because of direct and secondary exposure to hazardous asbestos fibers. Semtner has filed a suit in October in the Madison County Circuit Court in Illinois.
Semtner states that she had been a homemaker between 1966 and 1977. Since 1977, she has been working at different locations all through the Idaho and Washington, the lawsuit states. The plaintiff’s father worked between 1948 and 1969 as a maintenance worker with Milwaukee Railroad, according to the suit. Additionally, Semtner’s ex-husband worked for different employers as a laborer at locations all through Washington and Idaho, the complaint states.
Semtner states that she was heavily exposed to hazardous asbestos fibers through her father’s and ex-husband’s work clothes that they brought home following their job. Those work clothes were covered with toxic asbestos dust and Semtner was not at all aware of the hazards linked to them, the suit claims. The defendants failed to warn workers of the risks involved in their jobs, the suit claims.
The plaintiff states that her asbestos exposure was fully foreseeable and should’ve been expected by the defendant companies, the suit states. She alleges that her condition was caused as she inhaled / absorbed / ingested and was exposed to microscopic asbestos fibers which are known carcinogens.
Semtner claims that malignant mesothelioma has disabled as well as disfigured her permanently. Additionally, the condition will continue to force her to spend and become responsible for large amounts of money for essential treatments and medical care, the complaint states. The plaintiff also argues that she has experienced and will keep experiencing extreme physical pain and emotional anguish because of the disease.
The cancer hindered and prevented the plaintiff from pursing the normal course of employment and, as a result, caused her to lose large amounts of money, the lawsuit claims.
In her 8-count complaint, the plaintiff is seeking a judgment of more than $50000; more than $100,000 in exemplary and punitive damages; and more than $200000 in compensatory damages. Additionally, the plaintiff is asking for compensatory as well as punitive damages in order to punish the defendant corporations for their alleged misconduct and for deterring similarly situated parties from committing such unlawful acts in the future.
