Tennessee Couple Sues 111 Corporations in Mesothelioma Case

Edwardsville, IL – A Tennessee resident, along with his wife, is suing 111 companies, alleging that the malignant mesothelioma with which he was diagnosed was a result of the defendant’s negligence. The couple has filed a wrongful death asbestos suit against the companies.

The suit was filed by Charles Summey and his wife Elizabeth Summey in the Madison County Circuit Court. The couple says Charles contracted mesothelioma because of his occupational asbestos exposure.

The suit states that Charles worked between 1950 and 1954 in the United States Navy, between 1955 and 1957 at Magnavox as a stockman, and between 1957 and 1992 as a production worker / machine attendant at RCA. The couple says the exposure Charles suffered was quite foreseeable. It should’ve been well anticipated by the defendant companies, the suit states.

The couple alleges that Charles’ disease was caused as he inhaled, ingested, absorbed, or was exposed to hazardous asbestos fibers. They say the defendant companies are liable for the condition.

Summey and his wife say asbestos-linked disease disfigured and disabled Charles. Additionally, they incurred substantial medical expenses, the suit says. Charles has experienced and would continue to suffer physical pain as well as mental anguish, the lawsuit alleges. Mesothelioma prevented and hindered Mr. Charles from pursing the normal course of his employment, the couple claims in their suit. Thus he lost substantial amounts of money which would’ve accrued to him otherwise, the suit states.

Due to the disease, Elizabeth says she was deprived of the society, companionship, services, and consortium of her husband. In the eleven-count suit, the plaintiffs are asking for more than $100,000 in damages, in addition to exemplary damages and punitive damages of more than $100,000, and economic damages of more $150000. They are seeking other reliefs to which they could be entitled as well. Apart from this, Charles Summey and his wife are asking for a sum sufficient to appropriately punish defendants Ferris Kimball Co; Young Insulation Group of St. Louis; Sprinkmann Sons Corp; and Sprinkmann Insulation Incorporated for their alleged misconduct and also to deter other similarly situated entities from committing such illegal acts in the future.

Asbestos exposure (inhalation or ingestion of asbestos particles) is the only known reason for mesothelioma. In most cases, mesothelioma is a result of the victim’s occupational asbestos exposure.
