Kentucky Woman Says 49 Companies Responsible for Husband’s Death from Asbestos Lung Cancer

Charleston, West Virginia – A Greenup (Kentucky) woman has filed a lawsuit against 49 businesses that she believes are accountable for the lung cancer and eventual death of her husband.

The suit was filed by Mary Davis in Kanawha County Circuit Court. She says her husband Mr. Jack C Davis developed asbestos-related lung cancer and died from the disease a few months after the cancer diagnosis. According to Mary Davis, her husband had been exposed to asbestos as well as asbestos-containing products routinely while working as a carpenter and laborer. She believes his lung cancer was caused by this occupational asbestos exposure.

According to the complaint, the defendant companies negligently failed to warn the plaintiff’s husband of the hazards of asbestos, a naturally occurring mineral known to cause fatal diseases including cancer. Until the 1980s, asbestos was popular ingredient in numerous construction and other industrial products.

While working around dangerous asbestos products, Jack Davis was never warned about the risks or provided with enough safety apparel, the complaint says.

Mary Davis accuses the companies of: negligence; breach of implied and expressed warranties; contaminated buildings; intentional tort; strict liability; fraudulent misrepresentation; conspiracy; post-sale duty to warn; and failing to provide workers with essential protective equipment.

Mary Davis seeks a jury trial for fixing the issues involved in the case. A visiting judge has been assigned the case.
