Edgewater Resident Names 53 Companies as Defendants in Lawsuit over Malignant Mesothelioma

Charleston, West Virginia – An Edgewater (FL) man has filed a lawsuit against 53 defendant corporations over allegations that they are legally responsible for the diagnosis of his malignant mesothelioma.

On 21st April, James W Carnes was diagnosed by his doctors with malignant mesothelioma, a lawsuit filed in the Kanawha County Circuit Court indicates. Carnes alleges that he had been exposed to hazardous asbestos, asbestos fibres, and products containing asbestos during his career with VA Natural Gas and Elk refinery between 1953 and 1982.

The defendant companies are accused of negligence, violation of express warranty, violation of implied warranty, fraudulent misrepresentation, and failure to warn. The companies are also sued upon the theories of contaminated buildings, strict product liability, conspiracy, and intentional tort.

Carnes says he did not know the dangerous nature of the products with and around which he had been working regularly. The defendant companies never warned him either, the suit says. Additionally, the companies never provided the workers including Carnes with any sort of protective devices in order to prevent them from breathing in toxic asbestos dust and fibers, the complaint claims.

In his lawsuit, Carnes is asking for a jury trial for resolving every issue involved in the complaint. A team of West Virginia attorneys is representing Carnes in the legal battle. A visiting judge will oversee the case.
