Petition Seeks Asbestos Exposure History of Former Mobil Oil Employee Suffering from Mesothelioma

Beaumont, Texas – Mary Albright, a Beaumont resident, has filed a petition recently to perpetuate the testimony of Mr. Carl Albright after he allegedly developed malignant mesothelioma, a fatal cancer linked to asbestos exposure.

Mary Albright filed the petition on 17th February in the Jefferson County Dist. Court in Texas. The expected defendant in her pending lawsuit is oil giant ExxonMobil.

The petition says Carl Albert is suffering from malignant mesothelioma that is likely to progress and is expected to prove fatal. Ms. Albert’s petition is seeking Carl’s testimony about his career and exposure to asbestos at Mobil Oil.

Petitioner has notified the named defendants that she would institute a wrongful death and gross negligence lawsuit against them for damages, the petition says. According to Mary Albright, Carl’s devastating medical condition is a direct result of his exposure to hazardous asbestos and products containing the toxic mineral during his career with Mobil.

The petition is asking the court for authorizing Carl’s deposition. The case has been assigned to 172nd Dist. Court Judge Hon. Donald Floyd.

The petitioner says Carl was exposed on a daily basis to asbestos fibers and/or dust during the course of his employment, especially prior to the 1980. As a result of his routine exposure to the toxic fibres and/or dust while employed at Mobil Oil, Carl contracted malignant mesothelioma, a terminal type of cancer affecting the membrane which covers the cavities of a number of body organs, Mary Albright alleges.

The petitioner says the defendants failed to warn Carl Albert of the hazardous nature of asbestos and of the likely consequences of exposure to the products containing asbestos. She says there were unreasonable defects in the design as well as marketing of the asbestos products of the defendants. The petitioner is seeking monetary damages.

Malignant mesothelioma is an ailment in which cancerous (malignant) cells are developed in the layer of tissue which lines the chest cavity (pleura) or the layer of tissue which covers many organs and lines the abdomen (peritoneum). The exclusive risk factor for mesothelioma is exposure to asbestos fibers, especially long-term asbestos exposure. Symptoms of malignant mesothelioma include trouble breathing, pain under the rib cage etc. As these symptoms are also linked to several other less severe diseases, diagnosis of mesothelioma is extremely difficult. At present, malignant mesothelioma is not curable.
