Maricopa Couple Sues Companies over Asbestos-related Lung Cancer
A Maricopa (AZ) couple is suing several companies that made, marketed or used products containing asbestos over allegations that the defendants’ negligence caused the husband to develop asbestos-related lung cancer.
Manny Berry man and Martha Berryman have filed a lawsuit on 13 February in the Harris County District Court. The companies named as defendants in this case include: 3M Co; Viacom Incorporated; Certainteed Corporation; and Domco Products TX LP. The plaintiffs allege that the companies failed to provide Manny Berryman with a reasonably safe workplace.
The complaint states that Manny Berryman developed asbestos-related lung cancer because of his work-related exposure to various asbestos-containing products. He was diagnosed with the cancer on February 11, 2015, according to the lawsuit. The plaintiffs claim that Berryman’s injuries were a direct result of his exposure to the defendants’ products during his employment.
According to the plaintiffs, the defendant companies failed to provide Manny Berryman with adequate information and warnings of the health risks associated with regular exposure to products containing asbestos.
Because of his injuries, Manny Berryman suffered physical pain and suffering, mental anguish and emotional distress, and incurred a large amount of money in medical costs, the plaintiffs claim. Martha Berryman is suing the defendants for her alleged loss of consortium and loss of service of her spouse.
In their lawsuit, Manny Berry man and Martha Berryman are seeking unspecified exemplary and punitive damages and all other relief the court deems just and proper. The couple is demanding a jury trial to resolve the issues.
