Family Reaches Out-of-court Settlement in Mesothelioma Lawsuit

The family members of an Australian man who died after developing malignant mesothelioma has settled their case out-of-court. The family reached the settlement on Tuesday, just a day after the mesothelioma claim filed by the victim’s widow against the operators of the Wunderlich factory began in the Supreme Court of Victoria.

Samual Azzopardi, of Melbourne, died in 2016 February after developing malignant mesothelioma. The family claims that he contracted the fatal cancer due to his childhood exposure to toxic asbestos particles through the work clothing of his father who worked at the Wunderlich factory.

The attorney representing the family said his clients are happy with the finalization of the matter. However, the details of the settlement haven’t been disclosed.

Samual Azzopardi was 69 years old when his life was taken by mesothelioma, a terminal cancer affecting the mesothelial cells. His father Charlie was working at the Wunderlich factory. Charlie regularly brought asbestos fibers home through his work clothing after his job which involved cutting open bags of raw fibers. Azzopardi came into contact with these fibers on a daily basis, according to the suit filed by Samual Azzopardi’s widow. Charlie worked at the Wunderlich factory between the 1950s and 70s.

Samual Azzopardi suffered asbestos exposure once again while using the concrete sheets bought from Wunderlich for renovating the bungalow of his father, according to the claim.

Mesothelioma Claims and mesothelioma lawyers

All mesothelioma claims are filed on the basis that the defendant parties breached their legal responsibility to ensure the safety of people exposed to their asbestos-containing products. Asbestos victims do have the legal right to sue manufacturers and users of asbestos-containing products for failing to properly warn of the hazards associated with those products.

However, winning compensation payout for asbestos-related injuries is not a cakewalk. Whether or not one obtains compensatory damages depends on the specific facts of the case and the lawyer’s ability to navigate the procedural requirements of the court. That is why it is vital to hire a top mesothelioma lawyer to represent you in the legal battle. Your mesothelioma lawyer not only files the case in the court, but also deals with sending the concerned documents to all the defendant parties. This helps to gather more evidence and document filings, eventually leading to a court trial or an out-of-court settlement.
